CALL FOR EXPERTS

The project “Development of collective redress for consumers in South East Europe” supported by Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ), Open Regional Fund for South East Europe-Legal Reform is looking for independent experts with research experience in the field of consumer protection and collective redress.

This call seeks to identify external experts who can assist the project with a research activity on Collective redress in consumer protection in EU and SEE countries emphasizing cross-national comparisons, issues of commonality and difference. The objective of the research is to analyse the existing deficits and different obstacles in their entirety for an adequate enforcement of collective redress according to the consumer protection laws in SEE countries and to develop relevant suggestions for the improvement of the situation. The focus of the research will be the “Collective redress mechanisms in light of the European Commission Recommendation (2013/396/EU) on common principles for injunctive and compensatory collective redress mechanisms”.

 

The expert is expected to meet the following minimum requirements:

  • University degree in law or related discipline. Master or PhD degree will be considered as an advantage.
  • At least 7 years of professional experience in the field of consumer protection.
  • Fluency in both written and spoken English.

In addition to the minimum requirements, the expert is required to have:

  • Knowledge of the legal framework for consumer protection on national level and EU Law;
  • Knowledge and experience in research in the field of consumer protection on national level;
  • Experience in analysing case law;
  • Knowledge and skills for policy development.

The expert is expected to be able to perform the following tasks:

  • Carry out research based on complex methodology that will include diverse qualitative and quantitative research methods;
  • To analyse the legal framework on collective redress and transposition of the Directive 2009/22/EC, Directive 2013/11/EU, including the implications of Directive 2014/104/EU, the institutional framework and responsibilities for collective redress in different areas and application in practice in their respective countries;
  • Prepare policy recommendations for better regulation and enforcement of collective redress in consumer protection, to improve the existing institutional framework and design for a management model for the collective claims (collections of the claims, announcement of the claims, processing, etc.) in his/her respective country;
  • Prepare research report in national language and Executive summary in English language strictly following given guidelines; and
  • Cooperate with other national and regional experts in the delivery of the tasks.

The assignment will last from 15th of February until 15th of June 2017.

Please note that civil servants and other staff of the public administration from SEE countries cannot be recruited as experts.

GIZ reserves the right to review the documents of applied experts, asses if the nominated expert meet the requirements in full and make the final selection of the experts to be assigned.
